The Human Bean Privacy Policy

The Human Bean family of companies respects your privacy.  This Privacy Policy (“Policy”) is effective as of October 1, 2016.  It explains how we collect and use the personal information you may provide to us, and it will help you make informed decisions when using our website and services.  It applies to all the websites and services offered by us, including here at thehumanbean.com (the THB “Site”), the THB mobile applications (THB’s branded “Apps”), and at THB drive-thrus owned and operated by our affiliates and by our independent franchisees (THB’s branded “Services”).  We promise to follow this Policy, but it is not part of any contract between you and us.

 

This privacy policy covers the following areas:

 

    * what information we collect through the Site and Services;

    * how we use the information;

    * with whom we may share the information;

    * what choices you have about our collection, use and disclosure of the information;

    * what security procedures are in place to protect the loss, misuse or alteration of information under our control; and

    * how you can correct any inaccuracies in the information. 

 

Information Collection

THB collects two kinds of information: aggregated, anonymous, or quasi-anonymous data (Aggregated Info) and personally identifiable information (PII). The Site’s server logs collect Aggregated Info (such as browser type, ISP, IP address, referring/exit pages, platform type, date/time stamp, and number of clicks) from all visitors to the Site.  The Sites uses cookies and similar means to collect information about how the Site and Services are used. Information we gather through such means may include the pages viewed and the amount of time spent at the Site.  This type of information is typically not linked to your PII, and is used primarily in the aggregate to generate statistical reports about the use of our Site.  We reserve the right to connect any information collected through the Site with other personally identifiable information, including (i) when you create an account on the Site, and (ii) as needed to address any misuse of the Site.  The possible uses THB may make of your personal information are also described below.  We will not use the combined aggregated and personal information except as described. 

 

We collect PII when you register to use the Site or make a purchase on the Site. For registration, you are required to provide certain information, including an email address, name, telephone number, address and a password.  If you make a purchase on the Site using a credit card, your payment card data is encrypted for transfer to our payment processor, and the payment card data is not retained by us.  Other than payment card data for on-Site or in-App purchases, we will collect and retain the information you provide for registration or purchase.  We may also connect the information you provide to us with information provided by third parties, in order to give you a better customer experience. 

 

More about Cookies

Our Sites use both session ID cookies and persistent cookies. The session ID cookie terminates once you close the browser. For the persistent cookie, a text file is stored on your computer for an extended period of time. Persistent cookies can be removed by following Internet browser help file directions. If you allow the persistent cookie, our Sites can recognize your computer and your browser can remember your login information for our Sites. If you reject the cookie, your user experience may be limited.

 

Third Party Sites and Cookies

Links to sites other than the THB Sites may be displayed within our Sites and Services. These other sites may place their own cookies or other files on your computer, collect data or solicit personal information from you.  THB does not control and is not responsible for the privacy practices of sites other than the THB Sites, meaning that this Privacy Policy does not apply to the use of cookies or other privacy practices of any third parties, including advertisers.  You should carefully review the privacy policy of any site that solicits personal information from you.  THB does not use any third-party advertising on its Site, but advertisements from third parties may appear in the branded Apps.

 

Personal Information of Children under 13

Our Sites and Services are not directed to children, and we do not knowingly collect PII from children under 13 years of age.  Our registration page on the Site warns any users under 13 years of age not to submit PII.

 

Service Communications from THB

We may communicate with you by email or other means to provide requested services and resolve issues relating to your account, a transaction or our Services, as well as to send you any notice that we are required to send to you by law. You may not opt out of such transactional or service-related communications, but you may terminate your use of the Site at any time and request deletion of your account information.

 

Marketing Communications from THB

Within the THB family of companies, we may share your information with our affiliates and independent franchisees (a) for purposes other than direct marketing, for example improving the user experience of the Sites, protecting the security of the Sites, and defending claims against THB or its affiliates; and (b) unless you instruct us otherwise, for direct marketing purposes. From time to time we may send notices about products, services, special deals, or newsletters. You may withdraw permission to receive marketing communications at any time by following the instructions at the bottom of any THB marketing email, or contact us.

 

Disclosure of Information to Third Parties

We will not transfer or disclose your information to third parties, except (i) to our affiliates, independent franchisees, or service providers who will treat it in accordance with this Policy; (ii) as required by law; or (iii) as part of a business transition; please see the disclosure below regarding business transitions.   THB attempts to prevent non-affiliated third parties from using PII provided by you to THB to communicate with you for purposes of marketing.  Aggregate Info may be disclosed by us without restriction. 

 

Disclosure Required by Law.  We may disclose PII when required by law, or if we have a good-faith belief that such action is necessary to (i) comply with a current judicial proceeding, a court order or legal process served on us, (ii) protect and defend our rights, or (iii) protect the rights, property, and other interests of our users or others.

 

Business Transitions

In the event THB goes through a business transition, such as a merger, being acquired by another company, co-branding a product, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred.

 

Security

THB takes reasonable precautions in accordance with industry standards to protect our users’ information. At registration and at any time when you enter sensitive account information, such as debit or credit card information, your information is transmitted to our payment provider using encryption technology.  THB maintains procedures for notifying you in the event of a data security breach. If THB experiences a data security breach and is required to notify you under applicable law, THB will notify you by electronic mail using the e-mail address you have provided. You are responsible for ensuring that your contact information is current and correct. To review or change your information and correct any inaccuracies by deleting them, log in to the Site and update the information under the My Account tab or contact us.  If you make a request to THB regarding your personal information, we will respond within 10 business days. 

 

Deactivating Your Account

You may deactivate your THB account at any time by logging in to your account and choosing Preferences … Account Info … Delete Account, or contact us.  Some records relating to your account may remain on our servers or back-ups.

 

Notification of Changes

If we decide to change this Policy, we will post those changes here and in other places we deem appropriate, so you are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. If, however, we are going to use users’ personally identifiable information in a manner materially different from that stated at the time of collection we will notify users via email and by posting a notice on the Site  30 days prior to implementation of the new practices.

 

Non-U.S. Users

All of the THB drive-thrus are located in the United States of America,  and THB does not knowingly market its restaurant services to users outside of the USA.  THB processes and stores PII in the USA.  If you are outside the USA, information you submit to THB will be transferred out of your country and into the USA. When you accept THB’s Terms of Service, you agree to such transfers, and you warrant and represent that it is lawful for you to transfer the information into the USA.
